1. Agreement to Terms
By accessing or using the JoyKidos 144 Math Challenge application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
If you are a parent or guardian purchasing access for a child, you agree to these Terms on behalf of yourself and your child. You are responsible for ensuring your child understands and follows these Terms.
2. Description of Service
JoyKidos 144 Math Challenge is an educational application designed to help children practice mathematics through timed challenges. The Service includes:
- 144-question math challenges with a 5-minute time limit
- AI-powered difficulty adjustment
- Progress tracking and achievements
- Parent/guardian dashboard (coming soon)
3. User Accounts and Access Codes
3.1 Purchasing Access
Access to the full Service requires purchasing an access code. Access codes are purchased by parents/guardians and are intended for use by children under their supervision.
3.2 Access Code Terms
- Each access code provides lifetime access to one device
- Access codes are non-transferable
- You are responsible for keeping your access code confidential
- Lost access codes can be resent to the original purchase email
3.3 Account Security
You are responsible for maintaining the security of your access code and any activities that occur under your account. Please notify us immediately of any unauthorized use.
4. Payment and Refunds
4.1 Payment
Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and authorize us to charge your payment method.
4.2 Pricing
All prices are displayed in GBP (British Pounds) and include applicable taxes. We reserve the right to change prices at any time, but changes will not affect existing purchases.
4.3 Refund Policy
We offer a 30-day money-back guarantee. If you are not satisfied with the Service, you may request a full refund within 30 days of purchase by contacting us at support@joykidos.com.
Upon refund, your access code will be deactivated and you will no longer have access to the full Service.
5. Children's Use (COPPA Compliance)
5.1 Parental Consent
The Service is designed for children aged 5-12 but requires parental involvement:
- Parents must purchase access codes on behalf of their children
- Parents consent to the collection and use of their own information (email for delivery)
- We do not collect personal information directly from children
5.2 Parental Responsibilities
Parents and guardians agree to:
- Supervise their child's use of the Service as appropriate
- Ensure their child uses the Service in a safe environment
- Monitor their child's progress and well-being during math challenges
- Contact us with any concerns about their child's experience
5.3 Mixed Audience Statement
JoyKidos 144 Math Challenge is a "mixed audience" service under COPPA. While primarily designed for children, parents and educators may also use the Service. We apply COPPA protections to all child users regardless of other adult users.
6. Acceptable Use
You agree NOT to:
- Share, sell, or distribute access codes to unauthorized parties
- Attempt to hack, reverse engineer, or disrupt the Service
- Use the Service for any unlawful purpose
- Impersonate another person or entity
- Collect information about other users
- Use automated systems (bots) to access the Service
Violation of these terms may result in immediate termination of access without refund.
7. Intellectual Property
7.1 Our Content
All content in the Service, including but not limited to text, graphics, logos, icons, images, audio, and software, is the property of JoyKidos or its licensors and is protected by intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial educational purposes. You may not copy, modify, distribute, sell, or lease any part of the Service.
7.3 Feedback
If you provide feedback or suggestions about the Service, we may use them without any obligation to compensate you.
8. Disclaimers
8.1 Educational Purpose
The Service is intended as a supplementary educational tool. It is not a substitute for formal education, professional tutoring, or assessment of learning disabilities.
8.2 "As Is" Basis
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.3 No Guarantee
We do not guarantee that the Service will improve your child's math skills or academic performance. Results vary based on individual effort and other factors.
9. Limitation of Liability
To the maximum extent permitted by law, JoyKidos and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless JoyKidos, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
